As The Guardian notes, the fine followed an investigation into accusations that "operating system updates for older phones slowed them down, thereby encouraging the purchase of new phones".

The Italian antitrust watchdog found that "Apple and Samsung implemented dishonest commercial practices".

A statement from the competition authority reads, "The two companies have induced consumers to install software updates that are not adequately supported by their devices, without adequately informing them, nor providing them an effective way to recover the full functionality of their devices".

Apple also received a second €5 million fine for not providing consumers with information about the average lifespan of their phone's batteries, and how to replace and maintain them.

Italian consumer groups had complained that software updates for mobile phones reduced the functionality of the devices and were created to push clients into buying new handsets.

Basically, it means that they have been building the phones with the direct intention that they slow down over time, forcing you to buy a new one. The performance seemed to suffer on devices with batteries in poor condition. To their eyes, both companies pushed users to download updates that they knew would disrupt the phone's functioning.


Back in 2017 reports started to surface that Apple had reduced device performance for older iPhones by launching iOS 10.2.1.

Regardless, €10 million and €5 million for Apple and Samsung respectively is nothing. Both companies have to update their websites to say that they've been fined for this practice.

The Italian watchdog group also accused Samsung of neglecting to inform customers about the potential impact of the smartphone updates as well as neglecting to provide a way to restore the original functionality of the device (s).

That's not all the AGCM is annoyed with Apple about, however - it's also issued a second €5 million fine for those universal frustrations with iPhone batteries.

The Italian authorities see things differently. While it may not have been limiting CPU speeds, many users have complained about their older handsets feeling sluggish after major OS updates, including flagship ones like the Galaxy S8 and the Galaxy Note 8.
