Experts Say New SCOTUS Justice Spells End to Legal Abortion

The court's reversal is viewed as a victory for the Trump administration.

With U.S. Supreme Court Justice Anthony Kennedy set to retire next month, President Donald Trump said Wednesday that he plans to promptly start the process of selecting a successor for the high court's bench.

Several former law clerks have said that Kennedy, a nominee of President Ronald Reagan, preferred to be replaced by a Republican.

While Kennedy's replacement will not change the numerical ideological balance on the court, Trump could appoint a justice who would be more staunchly conservative than Kennedy and less likely to occasionally side with the court's liberal wing.

Lower courts had deemed the ban unconstitutional, but the United States top court reversed the decision in a 5-4 conservative majority ruling.

Senate Majority Leader Mitch McConnell (R) celebrated the ruling by tweeting from his campaign account a photograph of himself shaking hands with Gorsuch.

They also look at the political ramifications of Kennedy's retirement and how lawmakers are responding to the news.

In a strident dissent that she read from in court, liberal Justice Sonia Sotomayor said there were "stark parallels" with the court's now discredited 1944 decision that upheld U.S. internment of Japanese-Americans during World War Two.


The U.S. Senate, which must confirm nominees before they can join the court, is controlled 51-49 by Trump's fellow Republicans, meaning that if they remain unified they can overcome any Democratic opposition like that mounted against Gorsuch.

Ellison, the first Muslim elected to Congress, expressed his disappointment with both the Trump administration and the Supreme Court in their respective roles to justify the continuation of the travel ban. For one, it is not yet known when the Senate will vote on the nomination.

Following Trump's announcement of his "Muslim ban" a year ago, the country witnessed a wave of Islamophobia.

Soon after he was sworn into office in 2017, Trump nominated Judge Neil Gorsuch to succeed the late Supreme Court Justice Antonin Scalia, who had died a year earlier.
