Leader of the Opposition in the Rajya Sabha Ghulam Nabi Azad said the Opposition wanted the Bill to be sent to a select committee that would help make it strong by offering support to Muslim women and by removing the criminality clause.

One of the rationales behind the Supreme Court judgment of banning instant triple talaq was that it doesn't leave any scope for reconciliation.

The organisation which flagged this issue three years ago, the Bharatiya Muslim Mahila Andholan (BMMA), were shown on television screens distributing candies when this draconian law was passed in the Lok Sabha. There is a provision for a subsistence allowance from the husband for the livelihood and daily needs of the wife and the dependent children. "How will she feed her family?"

Opposition parties believe that the primary aim of the bill is for the BJP to increase its support among Muslims by appealing to the women in the community. He added: "The government did not hold proper discussions before tabling the bill". "It is a civil matter".

Maulana Abbas, however, said that the practice should be made a criminal offence. But the major bone of contention in the bill is the criminalisation of triple talaq.

"There is a greater consensus within the country that there should be a stringent law, preventive mechanism to give protection to Muslim women".


The Bharatiya Janata Party (BJP)-led National Democratic Alliance is in a minority in the Rajya Sabha.

The opposition members were firm in their stand that they are ready to support the cause but the bill is faulty and needs a second look.

According to Ms Baner-jee, she never opposed the bill keeping the protection of the women in mind.

The Congress government of Rajiv Gandhi reversing the apex court judgement had enacted a law which said the right to maintenance is only for the period of iddat (period of waiting for Muslim women after a divorce or demise of husband) after the divorce, thus shifting the onus of maintaining her to her relatives or the Wakf Board.

The parliamentary affairs minister said the government may table the bill in Rajya Sabha tomorrow. I want justice for all women. The repercussions will be worse. The ruling came in response to a petition filed by Muslim women's groups and victims of triple talaq and was hailed as a huge victory for India's 90 million Muslim women.

"There is no question of us not standing by anything that empowers women. We want to ensure the Bill goes through legislative scrutiny". The Congress has traditionally been seen as a supporter of conservative Muslim religious leadership; for its new image, to gain confidence of the Hindus, it needs to be seen as taking a distance from issues concerning the Muslim community. Talks on the model Nikhanama had begun 20 years ago. Many of the Islamic scholars opine that pronouncing it instantly three times will be counted as saying it only once. This is a social reform.
