It is sad that the Muslim Personal Law Board continues its negative stand on the issue of triple talaq.

The delegation headed by BJP Minority Morcha's Vice President Soni Tabasum and Nusrat met Jharkhand Chief Minister Raghubar Das in Ranchi yesterday.

"The bill not only goes against divorced Muslim women but also creates a confusion between the system of triple talaq and the instantaneous three talaqs", said Maulana Khalid Saifullah Rahmani, a member of the board, after an emergency meeting in Lucknow on Sunday.

Criticising the Muslim Women (Protection of Rights on Marriage) Bill, 2017, AIMPLB spokesperson Sajjad Nomani said: "After observing the provisions mentioned in the bill, it looks like that it is a kind of a conspiracy to grab the power of divorce from Muslims".

According to the draft law, which would be applicable to the entire country except Jammu and Kashmir, giving instant talaq would attract a jail term of three years and a fine. She said the government is trying to introduce the legislation following the directive from the Supreme Court to enact a law banning triple talaq. Now it is up to the court to direct the police as to whether they should investigate the matter.


As a matter of public policy, offences relating to marriage, as long as they do not result in any physical harm to the wife, are made non-cognizable and subject to judicial oversight to prevent third parties from seeking redressal of wrongs committed between two parties.

He said that since the Supreme Court struck down the practice of instant triple talaq, almost 66 cases of husbands divorcing their spouses through this method were reported. The onus now shifts to our parliamentarians to examine the Bill, and one hopes they will act with the same alacrity that they did when they summoned Sanjay Leela Bhansali in November in connection with his film Padmavati, which was facing protests, and asked him to assure them that the honour of a Hindu woman would not be besmirched.

It is also learnt that there is a strong dissent among the members of the All India Muslim Personal Law Board (AIMLB) and especially some women members are upset over board's handling of the situation.

AIMPLB, being a self-proclaimed representative body of Indian Muslims should have come up with their own version of draft bill instead of just condemning or requesting central government to withdraw it but as usual, they failed to give a concrete solution. It was hoped that being citizens of a democratic, progressive and responsive society, Indian Muslim clerics and other religious leaders would support steps that empower Muslim women and discard gender discriminatory practices such as triple talaq.
