Federal authorities have charged a Mexican man with new immigration and gun violations less than a week after a San Francisco jury acquitted him of murder for the shooting death of Kate Steinle.

A federal grand jury on Tuesday handed down an indictment of Jose Ines Garcia Zarate for a pair of felony gun charges.

Last week, a San Francisco jury acquitted Zarate of murder and manslaughter in the 2015 shooting death of Steinle.

Months before Kate Steinle's murder, San Francisco authorities released Jose Zarate from custody, ignoring a request from federal authorities to turn him over to ICE (Immigration and Customs Enforcement).

The charges, being a felon in possession of a firearm and ammunition and possessing a firearm and ammunition as an illegal alien, could bring Zarate a 10-year prison sentence. However he has been in jail since the shooting on July 1, 2015 and will get credit for time served.

Defense lawyers for Garcia Zarate said Monday they will appeal the state charge for which he was convicted.

Garcia Zarate had been deported five times before the 2015 shooting.


Garcia Zarate said he found a gun under a chair on a San Francisco pier.

Defense attorneys for Garcia Zarate argued the gun, which had been stolen from the vehicle of a Bureau of Land Management ranger, was accidentally fired by Garcia Zarate.

Shockingly, the jury was not told that Zarate was a 7-time convicted felon when deciding his verdict. The defense said the weapon went off by accident, and the bullet ricocheted off the ground and traveled about 80 feet before hitting Steinle.

Gascón called out Trump, saying that "we shouldn't allow a madman that is tweeting dictate everything we do" when talking about the influence politics has had on the Steinle trial.

President Donald Trump frequently brought up the case a year ago during his presidential campaign to criticize efforts in the U.S.to combat illegal immigration.

San Francisco is a so-called sanctuary city and local officials are limited in the cooperation they can give with federal deportation efforts.

San Francisco prohibits city law enforcement officers from asking about immigration status or detaining people exclusively on the basis of civil immigration detainers after they are eligible for release.
