"This cynical falsehood about a non-existent hotline was made to bolster O'Reilly's claim that the women who received settlements must have fabricated their claims or they would have complained", said Smith Mullin name attorney Nancy Smith, Bernstein's counsel. As the New York Times explains, these types of settlements typically include iron-clad confidentiality and nondisparagement clauses.

Rachel Witlieb Bernstein, a former junior producer at Fox News, is one of six women who reportedly entered into settlement agreements after alleging abuse by O'Reilly. In a suit filed Monday, she accused him of defamation and breach of contract over comments he has publicly made about the allegations.

"A History" author has time and again claimed that the harassment allegations that led to his ouster from the Fox News in April have no merit while adding that he resolved the matters privately just to protect his children.

The complaint, filed in NY federal court, also addresses statements from Fox News this past April. In the Times's April report, the news network claimed that they maintained an employee hotline and that no one had used the hotline to report O'Reilly (O'Reilly has repeated this claim as well).

"In fact, Mr. O'Reilly is the liar", claims Bernstein's lawsuit. "There is ample evidence that Fox News, with the complicity of top executives, enabled the abuse of women for many years then silenced them with non-disclosure agreements and non-disparagement clauses".

In addition to her claims against O'Reilly, Bernstein's lawsuit accuses Fox News of making a "deliberately misleading" statement regarding an employee hotline. "The worst part of my job is being a target for those who would harm me and my employer, the Fox News Channel".

Bernstein complained in 2002 that she was mistreated by O'Reilly when she worked for the network, and ultimately reached a settlement agreement with the network.

O'Reilly and spokesman Mark Fabiani did not immediately respond to a Law&Crime request for comment.

The plaintiff said she was not the source for the information printed in the Times story.

The lawsuit says Bernstein has suffered loss of income, emotional distress and sickness.
