Former Stanford University student Brock Turner has filed an appeal to overturn his 2016 sexual assault conviction and request a new trial, according to multiple reports.

They hope a new trial will also help overturn his mandatory lifetime requirement to register as a sex offender.

Turner ended up serving only three months of his sentence in a county jail thanks to good behaviour, having avoiding up to 14 years in a state prison after California judge Aaron Persky handed down the lenient sentence.

Turner, who was convicted of three felony counts of sexual assault, had said that the woman was awake and conscious throughout the incident.

Turner was indicted in March 2016 of different charges for the January 2015 rape of an oblivious, inebriated lady outside the Kappa Alpha crew on the Stanford University grounds.

Turner's lawyers did not immediately respond to request for comment.


In the appeal, lawyers for Turner argue their client was denied due process during his trial and called it "fundamentally unfair".

That characterisation of the crime, "implied an intent on the appellant's part to shield and sequester his activities" and "implied moral depravity, callousness and culpability on the appellant's part because of the inherent connotations of filth, garbage, detritus and criminal activity frequently associated with dumpsters", the document reportedly states. Jerry Brown previous year that added mandatory-minimum prison sentences for sexual assaults and expanded the definition of rape to include digital penetration would not apply because they were not in effect when the crime occurred.

A legal adviser for Turner, John Tompkins, doesn't deny the event happened, but insists it wasn't criminal. "It happened, but it was not anywhere close to a crime". "Nothing can ever roll back (the victim's) legacy of raising the world's awareness about sexual assault".

Turner was released after three months in prison.

Buzzfeed has obtained a copy of the motion, and say that Turner's lawyers are arguing that the jury was not supplied sufficient evidence of Turner's character.
