The order of protection gave Hudson primary custody of their son David Jr. and prevented Otunga from coming near her and their son. Otunga has always been the primary caregiver of the 8-year-old due to Hudson's commitments as an artist, so there wouldn't really be much of a change that will come out of this agreement.

Hudson has also dropped the emergency order of protection she filed against him, The Blast reported. David Jr.is now with Otunga while Hudson works in London. Otunga's been removed from their home, and as a result, we're told Jennifer's satisfied as the emotional risk to their son is no longer present. Hudson had Otunga thrown out of their home after he displayed "increasingly aggressive, threatening, harassing behavior". Jennifer is now in London shooting "The Voice UK" and she's committed to significant travel to Los Angeles to do "The Voice". "They have been in the process of ending their relationship for a number of months", the rep explained. Hudson and Otunga officially broke up and both of them wanted custody over their young son David Jr.

According to TMZ, Jennifer will continue making decisions based on what's best for her son. "Mr. Otunga looks forward to his day in court and in being awarded the residential care of the parties' only child", the statement read.


Rizzo insisted Otunga has never harmed, harassed or abused David Jr., and that Hudson's allegations were simply "false".

The couple had been dating less than a year when Otunga proposed to Hudson in 2008. Their son was born in August 2009. She also alleged he left a gun out on the counter, which she is "very sensitive" about considering her family history where her mother, brother and 7-year-old nephew were shot to death.
